1 - YOUR PERSONALISED TRIP, TAILORED TO YOUR NEEDS
Arts et Déserts (also referred to as the "Agency") offers the Traveller the opportunity to create a tour according to his/her wishes, and provides the Traveller with suggestions for tours, experiences and themes on the website www.artsetdeserts.com (hereinafter referred to as the "Site"), as well as suggestions for travel experiences and budget ideas. To obtain a personalised travel offer, the Agency invites the Traveller to submit a request via the email address " info@artsetdeserts.com". In the case of a group formed by the Traveller him/herself, the Traveller will officially be the recipient of the information provided by the Agency, and the Traveller must pass this information on to the other participants in his/her group.
Generally within 48 hours, an advisor from the Agency will propose to the Traveller, based on the expression of the latter's wishes, on a written medium with a period of validity, a travel programme and its firm and definitive price, all costs, taxes and services included, except for any minor adjustments in the services and tariffs, as provided for in Article 7 - Prices, below.
If the period of validity of the travel programme is exceeded and/or there are changes in the conditions of the services provided by the Agency, the latter may draw up a new programme for the Traveller's tour, if certain terms and conditions, in particular the price, are modified.
As soon as the Traveller wishes to confirm the travel programme within its validity period, he/she can register by sending an e-mail to :
"info@artsetdeserts.com", or directly to the Agency advisor in charge of your case.
As soon as the Traveller has confirmed his/her agreement to the travel programme, by paying a deposit or the total amount of the tour, the Agency will proceed to book the services mentioned in the quote, with the Agency's various partners/suppliers. Tailor-made tours mean that the services purchased must be constantly adjusted in line with the wishes of the Agency's Traveller customer. As soon as possible after the Traveller has registered, the Agency will inform the Traveller of the status of the confirmation of its services and, where applicable, will offer the Traveller alternatives if services are not available.
1.1 Registration
By registering, the Traveller agrees to undertake the trip as detailed in his travel programme.
Registration is validated by the Traveller's written confirmation, sent by email "info@artsetdeserts.com", indicating his/her agreement to the services indicated on his/her travel programme. With this written confirmation, the Traveller de facto accepts Arts et Déserts' terms and conditions of sale, as well as the payment to the Agency of the price of the trip in accordance with the terms and conditions specified in articles 1.2.1 and 1.2.2 below.
1.2 Terms of payment - invoices
Prior to any payment, the Traveller must provide the Agency, by e-mail, with his/her full name, postal address and telephone number, and attach the high-definition colour scan(s) of the passport(s) of the participant(s) as well as the copy(ies) of the international flight ticket(s).
1.2.1. For all registrations, whatever the date of departure, Arts et Déserts will collect a deposit of 30% of the total cost of the trip (hereinafter, the "Deposit"). For all bookings made less than 40 days before the departure date, payment must be made in a single instalment for the full price of the trip.
1.2.2. The Traveller may pay the price of his trip (deposit, then balance of the price for any registration made more than 40 days before the departure date or the total price for any registration made less than 40 days before the departure date):
The deposit must be paid by bank transfer to the Agency's account (the RIB will be sent to the Traveller).
The balance:
By bank transfer to the Agency's account in Bukhara 40 days before the trip.
Cash payment on arrival in Uzbekistan.
1.2.3. For any payment whose amount is validated and collected by Authentic Uzbek Travel, a receipt will be provided and an invoice will be sent to the Traveller who made the registration on behalf of the Traveller(s) of the travel programme. In the event of registration more than 40 days before the departure date of the trip, the balance of the price of the trip must be paid, without any reminder from the Agency, no later than 35 days before the departure date. Any delay in the payment of the balance will be considered as a cancellation on the part of the Traveller, for which the cancellation fees referred to in article 4 below will be applied. The Traveller does not benefit from a withdrawal period in respect of the purchase of travel services. The Traveller's registration is definitive upon receipt of the e-mail indicating his agreement to his travel programme. In the event of any difficulty, the Agency's advisors are available to assist the Traveller.
2- TRAVEL INFORMATION
2.1 -Administrative and health formalities
Before registering to embark on the tour, the Traveller must check that each member of his group, depending on his personal situation and nationality, is in possession of the passport, the validity of which must exceed 6 months after the date of return to his country of residence, and which will be used to carry out the planned trip, as well as any other document(s) (visa, authorisation to leave the territory, etc.) necessary and in compliance with the requirements for transiting and/or entering the country(ies) included in the tour. In order to organise the tour, the Traveller must send a colour copy of the personal data page of his/her group passport(s) at the time of registration. The Agency informs the Traveller that certain countries and/or service providers (in particular customs authorities, airlines, etc.) require the transmission of certain personal data in order to complete forms and/or comply with instructions relating to their reservation and/or control systems.
To this end, the Agency may be obliged to communicate the following data to these service providers: the surnames, first name(s) and date of birth appearing on the Passenger's passport, which the Passenger will use for his or her journey, and in order to complete the transit or entry authorisations (visa ....), to specify the gender (male (M) or female (F)) of each Passenger (including children and babies).
ATTENTION: the Traveller must provide the same information as above (surname, first name(s), date of birth and gender) in order to complete all other forms required for the completion of his/her journey. Failure to comply with this procedure may result in the Traveller being refused entry to the transit or destination country.
Arts et Déserts provides this information for all French nationals. For Travellers of other nationalities, the Agency recommends that they contact the Embassies of Uzbekistan, Turkmenistan, Kyrgyzstan, Tajikistan and Kazakhstan (depending on the tour agreed beforehand) to find out the administrative details for entry into the countries of Central Asia. It is the responsibility of each Traveller to check that his/her documents, in particular administrative and health documents, required in order to complete the trip, are in compliance with the rules for entry into the country(ies) crossed by the tour validated with Arts et Déserts, it being specified that it is the responsibility of the person who has registered for the travel contract to pass on information relating to formalities to each Traveller registered for the trip. Under no circumstances may Arts et Déserts be held liable for the consequences of a Traveller's failure to comply with police, customs or health regulations. A Traveller who is unable to carry out transport (in particular a flight) due to failure to present the required documents, as mentioned in the Agency's conditions of sale included on the Site, may not claim any reimbursement.
2.2 -Information on safety and health risks
For formalities and information on the country or countries to be visited, Arts et Déserts advises the Traveller to consult the country fact sheet(s) for the countries to be visited during the tour (destination countries and countries crossed) available on the website of the French Ministry of Europe and Foreign Affairs (MEAE) www.diplomatie.gouv.fr, under the heading "Conseils aux Voyageurs/ Conseils par pays". The Agency draws the Traveller's attention to the fact that the information may change up to the date of departure and advises the Traveller to consult it regularly.
Health risks: the Agency invites Travellers to regularly consult the information issued by the competent authorities on the health risks of the country/countries where they are travelling and to follow the health recommendations and measures to combat these risks. This information can be accessed on the websites http://solidarites-sante.gouv.fr/ (French Ministry of Solidarity and Health) and www.who.int.fr (World Health Organisation).
2.3-Accessibility
The Agency's personalised made-to-measure trips enable services to be envisaged that are adapted to the Traveller's personal situation, in particular if the Traveller has constraints in terms of travelling and/or carrying out all the activities inherent in a leisure trip (transport, accommodation, excursions, etc.). When the Traveller expresses his/her travel plans, he/she is invited to inform the Agency of any restrictions and/or particularities for each of the Travellers in his/her group, in order to enable the Agency to offer him/her adapted and accessible services in the event of reduced mobility. Arts et Déserts is at the Traveller's disposal to answer any questions relating to the accessibility of accompanied tours. If the Traveller's request includes transport services, in particular air transport, it is the Traveller's responsibility to inform the Agency in advance in order to organise the necessary assistance for transport, in particular air transport, both at the airport and in flight.
2.4 - Transmission of information
The Traveller making the registration in the name and on behalf of all the participants in the trip, undertakes to transmit to each Traveller the information provided by Arts et Déserts concerning the trip, so that the Agency cannot be held liable for any defect or omission in the transmission of this information.
3- MODIFICATIONS / INTERRUPTIONS TO SERVICES REQUESTED BY THE TRAVELLER
3.1-Transport services
After registration for the trip, any change to the transport, and in particular to the surnames/first names of the Traveller(s), may result in additional costs and/or penalties, the amount of which must be paid by the Traveller to Arts et Déserts by any means prior to departure.
In the absence of payment, the Agency shall not be obliged to make the desired changes.
3.2-Other services
After registration for the trip and before the departure date, any request for modification (additions or deletions: extension, delayed return, change of accommodation, etc.) of the travel services may only be made with the prior agreement of the Agency, and payment to the Agency of the costs incurred, by any means of payment that allows collection. In the absence of such payment, the Agency shall not be obliged to make the desired changes. From the date of departure, any request for modification and/or request not to carry out all or part of the travel services will not give rise to any reimbursement of the initial services. Any new service requested during the trip must be paid for in advance with the Agency.
3.3-Special cases
Any request to change the departure and/or return date may give rise to the invoicing of additional costs. Failure to pay the amendment fees will be considered as a cancellation/rescission on the part of the Traveller, for which the conditions set out in article 4 will be applied.
4- CANCELLATION/RESCISSION CONDITIONS AND COSTS
If the Traveller(s) booked on the tour are obliged to cancel their participation in the tour, they must inform their insurer and the Traveller who booked the tour must inform Arts et Déserts by email. The Agency will acknowledge receipt by the same means, as soon as the event giving rise to the cancellation occurs: the date of receipt of the letter will be used to calculate the costs.
The Traveller undertakes to take out travel insurance which, in accordance with the terms of the contract signed between the Traveller and the insurer, may reimburse the Traveller for the costs incurred in the event of cancellation of the tour previously accepted by the Traveller.
Depending on the services planned for the trip and in order to take into account the constraints imposed by the Agency's service providers, in the event of cancellation by the Traveller(s) before departure, Arts et Déserts will apply the following cancellation charges:
4.1 Scale of cancellation charges
More than 90 days before the departure date: 30% of the total price of the trip
89 to 60 days before departure: 40% of the total price of the trip
59 to 40 days before departure date: 75% of the total price of the trip
From 49 to 20 days before departure: 85% of the total price of the trip
19 days before departure date: 100% of the total price of the trip
A cancellation handling fee will be added to this scale:
500 per case
The total amount of cancellation charges (% charges + lump sum) may not exceed the total cost of the trip.
4.2-Partial cancellation fee
If one or more Travellers, registered on the same file, cancel(s) their participation(s) in a trip maintained for the other participants:
For personal services (not shared): the above cancellation charges (4.1) will be calculated, for the Traveller(s) who cancel(s), on the price of the services (flight tickets, etc.) not used up during the trip on the date of cancellation,
For shared services: a fee equal to 100%, regardless of the date of cancellation, will be charged to the Traveller(s) who cancel(s), on their share of the shared services for the trip,
If several travellers have registered for the same trip and one of them cancels, cancellation fees will be deducted from the sums collected by Arts et Déserts for this trip, regardless of who made the payment.
In the event of cancellation/rescission for any reason whatsoever, costs incurred by the Traveller outside the scope of the trip booked with Arts et Déserts (such as, by way of example and not exhaustively, transport costs to the place of departure of the trip and return home, costs of obtaining visas, travel documents, vaccination costs, etc.) will not be reimbursed in any way whatsoever.
On the date of cancellation by the Traveller(s), if his/her/their trip includes air and/or train tickets, and regardless of the amount received by Arts et Déserts (deposit and/or full price of the trip), the amount of the cancellation fees, which will be deducted from the deposit, will include Uzbek state taxes and/or airline boarding fees.
5- DOMESTIC AIR AND RAIL TRANSPORT
5.1 -Local air and rail companies
Arts & Déserts will inform the Traveller, on the travel programme, of the identity of the air carrier(s) likely to operate the flights during the tour accepted by the Traveller, with details of the timetables known on the date of acceptance of the programme, as well as the train timetables for the destinations specified on the programme.
In the event of a change subsequent to the Passenger's enrolment, the Agency undertakes to inform the Passenger of any changes to the timetable(s) of the carrier(s), as soon as it becomes aware of such changes and until the Passenger's departure.
Arts et Déserts specifies that :
In the event that the airline providing the domestic flight is unable to transport the Traveller, despite its obligation to provide assistance, Arts et Déserts may use another means of transport (train, road) in order to continue with the tour as planned.
In the event that the railway company cancels or reduces the number of people transported on the route listed in the programme, Arts et Déserts may review other timetables and/or another mode of transport to suit the rest of the tour.
5.2-Conditions of carriage by air
The airline's conditions of carriage, in particular the number of baggage items authorised and their maximum weight without supplement, are available on the airline's website or on request from Arts et Déserts.
In accordance with international air transport regulations, any airline may change its flight departure times without prior notice.
In the event of modifications by the local airline, in particular as a result of technical, climatic or political incidents outside the control of the Agency, delays or cancellations or strikes outside the control of the Agency, additional stopovers, change of aircraft, change of route, political or climatic events, the Traveller may not claim reimbursement and/or compensation from the Agency.
In the event of damage to or loss of baggage, it is the responsibility of each Passenger, in order to enable them to assert their rights vis-à-vis the airline, to retain all original documents (tickets, boarding passes, baggage vouchers, etc.) and to request any written proof from the airline in order to settle the dispute (hereinafter referred to as the "Proofs").
The Agency will assist the Traveller to the best of its ability in order to intervene with the airline so that the Traveller may recover his baggage(s), so that the course of the tour is not altered. All costs relating to the search for and/or return of the Traveller's effects will be borne exclusively by the Traveller.
6- TRAVEL INSURANCE
The Agency does not offer travel insurance to the Traveller. It is the Traveller's responsibility to take out insurance with a company or companies offering this type of cover.
7- PRICES
At the time of invoicing, the price is firm, definitive and in euros. However, in accordance with Uzbek law, up to 30 days before the departure date, the Agency may be obliged to make upward or downward adjustments, without the possibility of cancellation/resolution at no cost to the Traveller, to take account of any of the following variations:
Passenger fares resulting from the cost of fuel or other energy sources;
The level of government taxes or charges, on the travel services included in the contract, imposed by a third party who is not directly involved in the performance of the contract, including tourist taxes, landing taxes or airport embarkation and disembarkation taxes.
If one or more Traveller(s) registered on the same file cancels their participation in the trip, the trip may be maintained for the other Traveller(s) provided that the other Traveller(s) have paid, prior to departure, the possible additional cost of the services that had to be modified due to the cancellation of the Traveller(s). Any refusal on the part of the remaining registered Traveller(s) to pay this adjustment will be considered as a cancellation on the part of the Traveller(s) concerned, with application of the terms and conditions set out in article 4.
Fees, charges or other additional costs (by way of example and not exhaustively: tourist taxes, resort fees, entry to national parks, etc.) may be payable by the Traveller during the trip. These costs, which are not included in the total price of the trip, will, where applicable, be indicated on the Traveller's travel programme. Arts et Déserts advises the Traveller to have an appropriate means of payment for his/her trip.
8- UNUSED TERRESTRIAL SERVICES / MODIFICATIONS
Services not used during the trip (transfers, excursions, accommodation, vehicle hire, transport, etc.) due to the fault of the Traveller will not give rise to any reimbursement. As indicated in article 3, the services voluntarily modified on site at the request of the Traveller are subject to the conditions of the local service providers and suppliers and any additional costs must be paid directly to the local service providers, without Arts et Déserts being held liable. Services not used on site (transfers, excursions, accommodation, etc.) due to the fault of the Traveller will not give rise to any reimbursement.
9- ASSIGNMENT OF THE CONTRACT
The Traveller may assign his contract to a transferee who fulfils the same conditions as he does to make the journey, provided that the package has not produced any effects.
The Traveller is obliged to inform the Agency of his decision by any means that enables an acknowledgement of receipt to be obtained, and no later than seven days prior to the commencement of the trip. In the event of a transfer of contract, the transferor and/or transferee must first pay the costs incurred by the transfer, which will be communicated to them by the Agency.
10- LIABILITY
Arts et Déserts cannot be held responsible for the consequences of the following events:
Loss or theft of airline tickets (international flight(s)) by the Traveller.
Failure to present to the authorities and/or carriers (airlines, etc.) the administrative and/or health documents required to undertake the tour and/or enter the country(ies) of travel and/or cross the borders, in accordance with the information communicated by the Agency.
Arrival after the scheduled check-in and/or boarding time for any means of transport, particularly air transport. Arts et Déserts will not refund the cost of the ticket in this case.
Unforeseeable or unavoidable events of a third party such as: war, political unrest, strikes, epidemics and pandemics, riots or any other event external to Authentic Uzbek Travel, technical or administrative incidents external to the Agency, airspace congestion, bad weather, delays (including in mail dispatch services...), breakdowns, loss or theft of luggage or other personal effects of the Traveller(s).
Cancellation imposed by exceptional and unavoidable circumstances, and/or for reasons relating to the safety of the Traveller(s), and/or injunction from an administrative authority: in this event, Arts et Déserts reserves the right to modify the dates, times or itineraries scheduled if it deems that the safety of the Traveller(s) is at risk, without recourse from the latter.
In the event that the Agency is held liable due to the actions of its service providers (by way of example and not exhaustively: non-accessible accommodation, over-bookings, cancellation of means of transport, etc.), the Agency will take all necessary steps to ensure that the planned service is implemented at the same level of quality as that previously included in the programme accepted by the Traveller, without any change in the price contracted with the Traveller.
The disappearance of personal belongings will be the sole responsibility of the Traveller, unless this disappearance proves to be 1) linked to theft by break-in, 2) or and/or physical assault on the Traveller. The Traveller will file a report with the competent local authorities and reimbursement will be made by the service provider, if appointed, or by the Traveller's insurance. Under no circumstances will the Agency be liable for reimbursement due to the disappearance of the Traveller's belongings.
11-CLAIMS
During the tour, the Traveller is invited to contact the Agency if he/she notices any non-conformity in the provision of the services of his/her tour, by reporting the facts to the Agency guide in charge of his/her tour, or failing this, by telephoning the Agency directly, whose contact details will be given to him/her on the documents provided by Arts et Déserts. In the event of a complaint, account will be taken, where appropriate, of the failure to report any non-conformity in the provision of services during the Traveller's tour where this could have financial consequences.
12-PERSONAL INFORMATION
The information sent by the Traveller to the Agency is recorded in a computer file by Arts et Déserts, Uzbek government licence no. T-1308-16, whose registered office is located at 5/15 Murtazaev - 200100 Bukhara, Uzbekistan, in its capacity as data controller. Certain information must be provided to Arts et Déserts at the time of registration and/or request for a travel project by the Traveller. If this information is not provided, unfortunately the Traveller's requests cannot be processed. The processing of personal data is necessary to enable the Agency to offer a contract for the purpose of organising and executing the Traveller's tour.
13- TRAVELLER'S RIGHTS
The Traveller will receive all essential information about the tour before concluding the travel contract (registration form).
The Agency is responsible for the proper performance of all the services included in the contract.
The Traveller will receive an emergency telephone number or contact details enabling them to reach the tour organiser.
The Traveller may transfer his/her tour to another person, subject to reasonable notice and, where applicable, the payment of additional fees.
The price of the tour may only be increased if specific costs increase (e.g. fuel prices) and if this possibility is explicitly provided for in the contract and/or the conditions of sale, and may in no case be modified less than thirty days before the start of the tour.
In addition, the Traveller may cancel the contract at any time prior to the start of the tour, by paying the costs in accordance with the terms of articles 3 and 4 mentioned in the Agency's T&Cs.
If, after the start of the tour, important elements of the tour cannot be provided as planned, other appropriate services must be offered to the Traveller at no extra charge.
The Agency is obliged to provide assistance if the Traveller encounters difficulties during the tour organised by the Agency.
14- DISPUTES
The seller's registered office (Bukhara - Republic of Uzbekistan) is the sole place of jurisdiction for any disputes arising from the contract or the conduct of business.
